Is forex trading legal in Botswana?

Not legal advice. Below are the regulators’ own words, quoted from their official pages on the dates shown. Laws and rules change: check the regulator’s site before you open an account.

Facts verified on October 28, 2026

In Botswana, the Non-Bank Financial Institutions Regulatory Authority (NBFIRA) regulates and supervises non-bank financial institutions, including the securities industry under the Securities Act, 2014. It publishes lists of the entities it regulates on its website.

The quotes below come from a notice to stakeholders that NBFIRA published on its website, dated 6 June 2017. The notice says that the Securities Act, 2014 commenced on April 1, 2017, and it gives derivatives and futures or options on currency among the examples of securities that the Act’s definition covers. The quoted sentences cover financial instruments that can be accessed, offered or marketed through the internet, securities institutions that conduct their business through the internet, and securities exchanged over the counter (OTC), which the notice brings under the Regulatory Authority.

None of the quoted sentences mentions forex or contracts for difference (CFDs) by name. The quotes are in their original language, English, and date from 2017.

Before you open an account, check whether the firm appears in NBFIRA’s lists of regulated entities, which are linked from its website (link below).
